Immigration Detention and Removal Matters

Urgent Legal Protection When Your Freedom is at Risk.

If you or a loved one has been detained by the CBSA or is facing a Removal Order, time is your most critical asset. UMPC LAW provides immediate, aggressive representation to halt deportation and secure your release.

Overview of the Legal Issue

Facing detention or deportation is a legal emergency. Under Canadian law, the Canada Border Services Agency (CBSA) has the authority to detain non-citizens if they believe there is a flight risk, an identity issue, or a danger to the public.

Once a Removal Order (Departure, Exclusion, or Deportation) becomes enforceable, the clock starts ticking. Without immediate legal intervention, you could be removed from Canada within days, separating you from your family and barring you from returning for years—or permanently. The system moves incredibly fast, and navigating it alone is virtually impossible.

How UMPC LAW Helps

We act immediately to intercede with CBSA and the Immigration Division. Our priority is to stop the removal and get you home.

Detention Reviews

We represent you at the Immigration and Refugee Board (IRB) for your mandatory 48-hour, 7-day, and 30-day reviews. We argue for your release by proposing robust “Alternatives to Detention,” such as cash bonds or reporting conditions.

Refusal ManagementStays of Removal

In critical situations, we file urgent motions in the Federal Court to legally pause a deportation order when there is a risk of harm or a pending legal decision.

Deferral Requests

We negotiate directly with CBSA officers to delay removal on humanitarian or logistical grounds, buying you precious time to resolve your status.

The Legal Process

What to Expect

  1. Emergency Intake: You or your family must contact us immediately. We need to locate where you are being held (e.g., Calgary Remand Centre or Immigration Holding Centre) and review the reasons for detention.
  2. The Bond Hearing: We prepare a “Release Plan.” This often involves finding a “Bondsperson” (a Canadian citizen or PR) willing to post money and supervise you.
  3. The Decision: We present your case to a Board Member. If successful, you are released on specific conditions.
  4. Long-Term Defense: Once you are released, we shift our focus to fighting the underlying removal order to secure your permanent status in Canada.
