Overview of the Legal Issue
Receiving a negative decision on your refugee claim is heartbreaking and terrifying. You may feel like your options have run out, but the Canadian legal system provides a specific pathway for review called the Refugee Appeal Division (RAD).
The RAD is designed to correct errors made during your initial hearing. However, this is not a “do-over” or a new hearing. It is a highly technical, paper-based review where you must prove that the decision-maker made mistakes in law or fact. You have a very short window—only 15 days from receiving your written reasons—to file an appeal. Missing this deadline can lead to a removal order becoming enforceable.

The Legal Process
What to Expect
- Immediate Intake: You must contact us as soon as you receive your decision. Every hour counts.
- Filing the Notice: We file the “Notice of Appeal” within the strict 15-day deadline to stop any deportation actions.
- Perfecting the Appeal: We have a limited time (typically 30 to 45 days) to submit the “Appellant’s Record.” This includes our detailed legal arguments explaining exactly why the original decision was wrong.
- The Decision: The RAD will review our written arguments. They can either confirm the refusal, substitute a new positive decision (granting you status), or send the case back for a new hearing.
