Assault and domestic charge lawyer in Calgary

Assault allegations, especially between partners or family members, often come with immediate conditions that keep you away from your home and children. We act quickly on those conditions while we defend the charge.

Assault charges range from simple assault to assault causing bodily harm, assault with a weapon and aggravated assault. When the allegation involves a partner or family member, police in Alberta generally lay charges where they believe an offence occurred, and release conditions commonly prohibit contact with the complainant and attendance at the family home.

These conditions can last for months. Planning for where you will live, how parenting will work and how to deal with shared property is part of the defence from the start.

How we defend assault charges

  • Reviewing statements, 911 recordings, photos, medical evidence and body-worn camera video.
  • Identifying defences such as self-defence, consent, or the reliability and credibility of the evidence.
  • Raising Charter issues arising from the arrest, search or questioning.
  • Exploring alternatives such as a peace bond or, where appropriate, programs that can lead to a resolution without a conviction.

No-contact conditions and your family

Release conditions can be changed, either by agreement with the Crown or by application. Where there are children or shared property, we coordinate with any family law steps so that the criminal and family matters do not undermine each other.

Immigration consequences

Some assault convictions can make permanent residents and foreign nationals inadmissible to Canada. We consider the immigration consequences before you decide how to resolve the charge.

How an assault case usually proceeds

  1. Release

You are released with conditions or held for a bail hearing.

  2. Disclosure

We obtain the Crown’s evidence and review it with you.

  3. Options

We discuss withdrawal, a peace bond, alternative programs, resolution or trial.

  4. Resolution or trial

We negotiate with the Crown or defend you at trial.

Frequently asked questions

The complainant does not want to proceed. Will the charge be dropped?

Not automatically. The Crown decides whether to proceed. The complainant’s wishes are considered, but the Crown may continue with the case.

Can I contact the complainant to sort things out?

Not if your conditions prohibit it. Breaching a no-contact condition is a separate offence. Speak with us about changing the condition instead.

What is a peace bond?

A peace bond is an order to keep the peace and follow conditions for a period of time. It is not a criminal conviction, and in some cases it resolves a charge.
